Texas employers have access to several federal and state tax credit programs that can reduce their overall tax liability. While Texas has no state income tax, the franchise tax and federal tax obligations create multiple opportunities for credits. Understanding which credits apply to your business can generate significant savings across payroll, capital investment, and workforce development.
Federal Tax Credits for Texas Employers
Work Opportunity Tax Credit (WOTC)
WOTC provides tax credits of $1,200 to $9,600 per qualifying hire for employers who hire individuals from designated target groups, including veterans, long-term unemployed, SNAP recipients, ex-felons, and others. Texas employers must submit IRS Form 8850 to TWC within 28 days of the employee's start date.
R&D Tax Credit
The federal Research and Development (R&D) Tax Credit under IRC Section 41 provides a credit for qualified research expenses. Texas manufacturers, technology companies, and engineering firms commonly qualify. Startups with less than $5 million in gross receipts can apply the credit against payroll taxes.
Empowerment Zone Tax Credits
Employers operating in designated Empowerment Zones can claim a tax credit for wages paid to zone residents. Some Texas communities have active Empowerment Zone designations that provide this benefit.
Employer-Provided Childcare Credit
Under IRC Section 45F, employers that provide childcare facilities or contract with childcare providers for their employees can claim a credit of up to 25% of qualified childcare expenditures.
Disabled Access Credit
Small businesses that incur expenses to comply with ADA requirements can claim a credit of up to $5,000 annually for eligible access expenditures.
Texas Franchise Tax Benefits
Franchise Tax Rate Reductions
While the Texas franchise tax is not a traditional income tax, qualifying businesses can take advantage of reduced rates. The franchise tax rate for qualifying wholesalers and retailers is lower than the standard rate. Businesses with total revenue under the no-tax-due threshold are exempt from filing.
Solar and Wind Energy Device Deduction
Texas businesses that install solar or wind energy devices may deduct the cost from their franchise tax appraisal. This complements the federal Investment Tax Credit for renewable energy.
Property Tax Benefits
Freeport Exemption
Inventory shipped out of Texas within 175 days can be exempted from local property taxes in jurisdictions that have adopted the exemption.
Pollution Control Equipment Exemption
Equipment used wholly or partly to control air, water, or land pollution can be exempt from property taxes.
Maximizing Tax Credits
- Screen every new hire for WOTC eligibility before or on the start date
- Track R&D activities and expenses throughout the year
- Review inventory management for Freeport Exemption eligibility
- Consult with a qualified tax advisor on credit stacking opportunities
