The Texas Enterprise Zone Program is a state incentive program administered by the Office of the Governor's Economic Development and Tourism Division. It provides state sales and use tax refunds to businesses that create jobs and make capital investments in economically distressed areas of Texas. The program is designed to encourage private investment in communities that have experienced high unemployment, poverty, or economic decline.
How the Enterprise Zone Program Works
Under the program, a city or county nominates a business project for Enterprise Zone designation. If the project meets the requirements, the business can apply for a state sales and use tax refund on purchases related to the project. The refund amount is tied to the number of jobs created and the level of capital investment.
Eligibility Requirements
- Location: The project must be located in an area that qualifies as economically distressed under the program criteria. Qualifying areas include enterprise communities, areas with high unemployment or poverty rates, defense economic readjustment zones, and other designated areas.
- Local nomination: The city or county governing body must nominate the project as an enterprise zone project through a formal resolution.
- Job creation: The business must commit to creating a minimum number of permanent jobs (at least 10 for designation).
- Capital investment: The business must make qualified capital investments in the project.
Refund Amounts
The maximum state sales and use tax refund depends on the number of jobs created or retained:
- 10 to 24 jobs: up to $2,500 per job
- 25 to 49 jobs: enhanced refund amounts per job
- 50 or more jobs: maximum refund levels per job
Refunds are available for state sales and use taxes paid on equipment, machinery, building materials, electricity, natural gas, and other items used at the project site.
Application Process
- Contact local economic development: Work with the city or county to determine if your project location qualifies and obtain a local nomination.
- Submit designation application: Apply to the Governor's Office for Enterprise Zone designation.
- Receive designation: If approved, the business receives enterprise zone project status.
- Track qualifying expenditures: Maintain records of state sales and use taxes paid on qualifying purchases.
- Apply for refunds: Submit refund applications to the Texas Comptroller as you meet job creation milestones.
Enterprise Zone vs. Other Programs
The Enterprise Zone Program focuses specifically on state sales tax refunds tied to job creation in distressed areas. It is different from property tax abatements (Chapter 312), Chapter 380 agreements, and the Texas Enterprise Fund, though businesses may combine multiple programs for a project.
